The terms "we", "us", and "our" refer to J&M's Workshop. J&M's Workshop operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the "Services").
J&M's Workshop is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein (collectively, the "Terms"), describe your rights and responsibilities when you access or use our website, purchase products, submit custom artwork, or otherwise use our Services.
Please read these Terms carefully. They include important information regarding orders, custom products, intellectual property, warranties, limitations of liability, and other legal rights and obligations.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use the Services.
Nothing in these Terms limits any rights or remedies that cannot legally be waived under applicable consumer protection laws.
SECTION 1 — ACCESS AND ACCOUNT
By using the Services, you represent that you have reached the age of majority in your province, state, or other jurisdiction of residence, or that you are using the Services with the permission and supervision of a parent or legal guardian where permitted by law.
To purchase products or use certain features of the Services, you may be required to provide information including your name, email address, billing information, payment information, and shipping address.
You represent that the information you provide is accurate, current, and complete and that you have the right to provide such information.
You are responsible for maintaining the security of your account credentials and for activities conducted through your account. You may not transfer, sell, assign, or license your customer account to another person without our permission.
SECTION 2 — OUR PRODUCTS
J&M's Workshop offers a variety of products that may include custom printed stickers, QR code stickers, business cards, stationery, handmade crochet products, selected craft products, decorative products, and other merchandise.
Some products are designed, customized, handmade, assembled, printed, sourced, or curated by J&M's Workshop. Unless expressly stated on a product page, the sale of a product does not necessarily mean that the product was manufactured by J&M's Workshop.
We make reasonable efforts to describe and display our products accurately. However, actual colours, textures, dimensions, print appearance, and other product characteristics may vary slightly due to screen settings, manufacturing tolerances, handmade variations, materials, lighting, photography, and other factors.
Handmade products may contain minor variations in shape, colour, dimensions, placement, or finish. These variations are part of the nature of handmade goods and are not necessarily defects.
Product descriptions, availability, specifications, and pricing may be changed at any time without notice.
We reserve the right to discontinue products or limit quantities available to any person, geographic region, or jurisdiction, subject to applicable law.
SECTION 3 — CUSTOM AND PERSONALIZED PRODUCTS
Certain products offered by J&M's Workshop are customized, personalized, printed, or otherwise produced using information, text, logos, QR codes, designs, images, artwork, or other materials supplied or approved by the customer ("Customer Content").
When submitting Customer Content, you represent and warrant that:

you own the Customer Content or have all permissions, licences, and legal rights necessary for J&M's Workshop to reproduce and use it in fulfilling your order;

the Customer Content does not infringe any copyright, trademark, trade dress, publicity right, privacy right, or other right of any third party; and

the Customer Content does not violate applicable law.
You grant J&M's Workshop a limited, non-exclusive licence to reproduce, modify where technically necessary, print, manufacture, and otherwise use the Customer Content solely as reasonably necessary to prepare, produce, fulfill, and support your order.
We reserve the right to decline or cancel a customization request that we reasonably believe may violate applicable law or the intellectual property or other rights of a third party.
Proof Approval
For certain custom products, we may provide a digital proof for approval before production.
You are responsible for carefully reviewing all spelling, names, dates, dimensions, colours, QR code content, URLs, contact information, artwork placement, and other details shown in the proof.
Once you approve a proof, production may begin and changes or cancellations may no longer be possible.
J&M's Workshop is not responsible for errors contained in Customer Content or in a proof that the customer reviewed and approved, except where required by applicable law.
SECTION 4 — ORDERS
When you place an order, you are making an offer to purchase products or services from J&M's Workshop.
We reserve the right to accept or decline an order for legitimate business reasons, including product availability, pricing or listing errors, suspected fraud, inability to fulfill customization requirements, or legal or intellectual property concerns.
An order is accepted when we confirm acceptance or begin fulfillment, subject to applicable law.
Payment must be successfully authorized before an order can be processed.
Please review your order carefully before submitting it. Custom or personalized orders may not be cancellable after production has started or after a proof has been approved.
Returns, exchanges, refunds, and cancellations are governed by our Return and Refund Policy.
Products may be purchased for personal use, gifting, business use, packaging, promotional use, or other lawful purposes. Products may not be resold in a manner that falsely represents their source, manufacturer, ownership, or affiliation with J&M's Workshop.
SECTION 5 — PRICES AND BILLING
Prices, discounts, and promotions may change without notice.
The price charged will be the price displayed and confirmed at checkout at the time the order is placed, subject to correction of obvious errors as permitted by applicable law.
Unless otherwise stated, product prices may not include shipping charges, taxes, customs duties, brokerage fees, or import charges.
Customers in different countries or markets may see different currencies, prices, shipping rates, promotions, or product availability.
You agree to provide accurate and complete billing and payment information and to promptly update information where necessary.
You represent that you are authorized to use any payment method submitted for your purchase.
SECTION 6 — SHIPPING AND DELIVERY
Orders are shipped in accordance with our Shipping Policy.
Processing and delivery times are estimates unless expressly stated otherwise.
Custom and personalized products may require additional production time before shipment.
Delivery may be affected by carriers, customs processing, weather, holidays, labour disruptions, incorrect addresses, border processing, or other circumstances outside our reasonable control.
For international shipments, customs duties, brokerage fees, import taxes, or other charges may apply. Responsibility for such charges will be disclosed or handled in accordance with the information presented at checkout and our Shipping Policy.
Risk of loss and legal rights relating to delivery are governed by applicable law. Nothing in these Terms limits rights that customers may have under mandatory consumer protection legislation.
SECTION 7 — RETURNS, REFUNDS, AND CANCELLATIONS
Returns, exchanges, cancellations, and refunds are governed by our Return and Refund Policy.
Custom and personalized products are generally not returnable or cancellable after production has begun or a proof has been approved, except where an item is defective, damaged, incorrect, materially different from the approved proof, or where applicable law provides otherwise.
If an order arrives damaged, defective, or incorrect, please contact us within the period stated in our Return and Refund Policy.
SECTION 8 — INTELLECTUAL PROPERTY
Except for Customer Content and materials owned by third parties, the Services and their contents—including text, graphics, photographs, product descriptions, branding, layouts, designs, and other materials—are owned by or licensed to J&M's Workshop and are protected by applicable intellectual property laws.
The J&M's Workshop name, branding, logos, graphics, designs, and original content may not be copied, reproduced, distributed, commercially exploited, or used in a manner that suggests affiliation, sponsorship, or endorsement without our prior written permission.
Third-party trademarks, logos, designs, characters, artwork, and other intellectual property appearing on products or materials remain the property of their respective owners.
Nothing in these Terms transfers ownership of Customer Content to J&M's Workshop.
SECTION 9 — OPTIONAL AND THIRD-PARTY TOOLS
We may provide access to tools, integrations, payment services, applications, or services provided by third parties.
Such third-party tools may be provided "as is" and "as available" and may be governed by separate terms and privacy policies.
Your use of third-party tools is at your own discretion and subject to the terms of the applicable provider.
We may add, modify, or discontinue features, tools, or integrations from time to time.
SECTION 10 — THIRD-PARTY LINKS
The Services may contain links to websites, platforms, or services operated by third parties.
We are not responsible for the content, accuracy, security, availability, products, services, or policies of third-party websites.
If you choose to access or transact with a third-party service, you do so subject to that third party's terms and policies.
SECTION 11 — RELATIONSHIP WITH SHOPIFY
J&M's Workshop is powered by Shopify, which enables us to provide the Services to you.
However, sales made through our store are transactions directly between you and J&M's Workshop.
Shopify is not the seller of the products purchased from J&M's Workshop and is not responsible for the manufacture, customization, quality, fulfillment, shipping, return, or performance of such products, except to the extent required by applicable law or expressly provided through a Shopify service.
SECTION 12 — PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our store is hosted by Shopify, certain personal information may also be collected, processed, or stored by Shopify and other service providers involved in providing our website, checkout, payments, fraud prevention, analytics, fulfillment, or related services.

SECTION 13 — FEEDBACK AND REVIEWS
If you voluntarily provide reviews, comments, suggestions, photographs, testimonials, feedback, or other content ("Feedback"), you represent that you have the right to provide that content.
Subject to applicable law and any permissions presented when the Feedback is submitted, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, display, and distribute Feedback for purposes including operating and promoting J&M's Workshop.
You remain responsible for the accuracy and legality of Feedback you submit.
Nothing in these Terms prevents a customer from posting or communicating an honest review of our products, Services, or a transaction.
SECTION 14 — ERRORS, INACCURACIES, AND OMISSIONS
Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions relating to product descriptions, availability, pricing, promotions, shipping charges, delivery estimates, or other information.
We reserve the right to correct errors and update information and, where permitted by applicable law, cancel or modify an affected order.
If an order is cancelled after payment because of an error we cannot reasonably honour, the applicable payment will be refunded.
SECTION 15 — PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services to:
- violate applicable laws or regulations;
- infringe our intellectual property rights or those of another person;
- submit fraudulent, deceptive, abusive, threatening, defamatory, obscene, or unlawful content;
- introduce viruses, malware, or harmful code;
- attempt to gain unauthorized access to systems or accounts;
- collect personal information unlawfully;
- interfere with the operation or security of the Services;
- engage in fraud, phishing, spam, impersonation, or other malicious activity; or
- circumvent technical security or access controls.
Reasonable access by legitimate search engines, indexing services, accessibility tools, and other automated services that identify themselves appropriately and comply with our published technical access controls is not prohibited by this section.
SECTION 16 — AUTOMATED AGENTS
Automated or semi-automated software, including AI agents, may interact with our Services only in a lawful manner and in accordance with applicable technical access controls, platform requirements, and these Terms.
Automated systems must not misrepresent themselves as human users, circumvent CAPTCHAs or security measures, interfere with the Services, access restricted areas without authorization, or engage in scraping or data collection that violates applicable law or our rights.
We may limit or block automated access that adversely affects security, performance, privacy, intellectual property, or the operation of the Services.
Nothing in this section is intended to prohibit ordinary indexing or discovery by legitimate search engines or other services that we have authorized or permitted through our technical configuration.
SECTION 17 — TERMINATION
We may suspend or terminate access to all or part of the Services where reasonably necessary, including for violations of these Terms, unlawful conduct, security threats, suspected fraud, or abuse.
Termination does not affect obligations that arose before termination.
Provisions that by their nature should survive termination—including provisions relating to intellectual property, liability, indemnification, and governing law—will continue to apply.
SECTION 18 — DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR RIGHTS OR WARRANTIES THAT CANNOT LEGALLY BE EXCLUDED, THE SERVICES AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
WE DO NOT GUARANTEE THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY STATUTORY WARRANTY, CONDITION, CONSUMER GUARANTEE, OR OTHER RIGHT THAT CANNOT LEGALLY BE WAIVED.
SECTION 19 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, J&M'S WORKSHOP AND ITS OWNERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS.
THIS MAY INCLUDE LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, OR OTHER CONSEQUENTIAL LOSS.
THE ABOVE LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW AND DO NOT LIMIT LIABILITY THAT CANNOT LEGALLY BE LIMITED OR EXCLUDED.
SECTION 20 — INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless J&M's Workshop and its owners, employees, contractors, and service providers from third-party claims, losses, liabilities, damages, or reasonable legal expenses arising from:
- your material breach of these Terms;
- your unlawful use of the Services;
- your violation of another person's rights; or
- Customer Content that you provide for customization and that infringes or violates the rights of another person.
This section does not apply to the extent a claim results from our own negligence, unlawful conduct, or breach of applicable law.
SECTION 21 — SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue in effect.
SECTION 22 — WAIVER AND ENTIRE AGREEMENT
Failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.
These Terms, together with policies incorporated by reference and information presented during checkout, constitute the agreement governing your use of the Services and purchases from J&M's Workshop, subject to rights provided by applicable law.
SECTION 23 — ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise.
We may assign or transfer our rights and obligations as part of a legitimate transfer, reorganization, or sale of the business, subject to applicable law.
SECTION 24 — GOVERNING LAW
These Terms and transactions with J&M's Workshop are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without limiting any mandatory consumer protection rights that may apply to you in your place of residence.
Nothing in this section requires a consumer to waive rights, remedies, or jurisdictional protections that cannot legally be waived.
SECTION 25 — CHANGES TO THESE TERMS
We may update these Terms from time to time.
The current version will be posted on this page. Where required by applicable law, material changes will be communicated or will take effect only after any required notice period.
Your continued use of the Services after an updated version becomes effective constitutes acceptance of the updated Terms to the extent permitted by law.
